The U.S. freight industry is bracing for a significant workforce shift following the Federal Motor Carrier Safety Administration (FMCSA) final rule, which took effect on March 16, 2026. The new regulations fundamentally alter who can hold a non-domiciled commercial driver’s license (CDL), restricting eligibility to narrow visa categories like H-2A, H-2B, and E-2. By eliminating Employment Authorization Documents (EADs) as a valid pathway, logistics leaders are now facing compounding non-domiciled CDL capacity risks that threaten to tighten supply chains and drive up spot rates.

Logistics experts must verify that every foreign-born driver operates under an eligible visa to avoid sudden out-of-service penalties. As the driver pool gradually shrinks through attrition, successful fleets will leverage targeted recruitment, strict compliance monitoring, and adjusted freight pricing to navigate these non-domiciled CDL capacity risks.
